This page explains what services Gymie provides and on what terms, how to create and delete an account, the rules for content you send to friends, and how to make a complaint.
Service provider
These terms set out how you may use Gymie: the mobile app for iOS and Android, the getgymie.com and gymie.pl websites, and the connection between Gymie and AI assistants. They are the terms of service required by Art. 8 of the Polish Act of 18 July 2002 on providing services by electronic means.
The services are provided by Hubert Jaruzal ASGARD, Poland, VAT ID (NIP) PL7642677506 (the "provider", "we"). Contact: hubertjaruzal@gmail.com.
These terms are available free of charge at getgymie.com/terms, both before you enter into the contract and while you use Gymie. You can save or print them from your browser.
What the services are
Gymie is a training and diet app. By electronic means we provide:
- The app without an account: workout plans and logging, a voice coach that talks you through your workout, a meal diary, and your goal and its calculation. Without an account, your data stays on your phone only.
- An account: sign-in and data sync, so your data survives a reinstall and is available on another device.
- Profile photo (with an account): an optional photo next to your name, which any signed-in Gymie user who has your account's identifier can see; in practice the app shows it wherever your account appears.
- Friends (with an account): invites, knowing that a friend is working out right now, voice messages (up to 60 seconds) and captioned photos sent during a friend's workout, and joint workouts of up to 4 people.
- AI meal analysis (with an account): estimates of calories and macros from photos of a meal or from a description alone, with a daily limit per person.
- Connecting an AI assistant (with an account): access for the AI assistant you choose, such as Claude or ChatGPT, to part of your Gymie data over the MCP protocol.
- Reading from Apple Health and Health Connect: steps and active calories shown in the app, with your permission given in the system.
- The getgymie.com and gymie.pl websites: information about Gymie, these terms, the privacy policy and the account deletion page.
Gymie is not a medical device and does not replace a doctor, a dietitian or a coach.
Technical requirements
To use Gymie you need:
- an iPhone with iOS 16.4 or later, or a device with Android 8.0 or later, with the Gymie app from the App Store or Google Play;
- an internet connection to create an account and sign in, sync your data, and use the friends features, meal analysis and the assistant connection (your carrier may charge for data);
- an email address to create an account;
- to read steps and calories: the Health app on iPhone or Health Connect on Android, and your permission in the system settings;
- for photos and voice messages: access to the camera, photos and microphone, which the app will ask for;
- to connect an AI assistant: an account with an assistant provider that supports MCP connections, on that provider's terms;
- for the websites: an up-to-date browser with JavaScript enabled, and with cookies enabled to connect an assistant.
Downloading the app is also subject to the terms of the App Store or Google Play.
Entering into the contract and your account
The contract for using the app without an account is concluded when you first open the app, and the contract for using the websites when you open them. The first ends when you remove the app from your phone, the second when you close the page.
The contract for an account is concluded when you create an account in the app, for an indefinite period. By creating an account you accept these terms.
Gymie is for people who are at least 16 years old.
Your account is personal: you may not share it or hand it over to anyone else. Keep your sign-in details to yourself, and if they leak or your account is taken over, write to hubertjaruzal@gmail.com. Your profile should be accurate, because your goal and targets are calculated from it.
Free of charge, with limits
Gymie is free. We charge nothing for the app, the account or any of the services described here, and we show no ads.
Some features have daily limits, so the service stays fair for everyone: meal analysis has a daily limit per person, counted in photos (a description of the meal alone counts as one photo), and a connected AI assistant can save at most 200 changes a day.
If we ever introduce paid features, we will describe them and their prices in these terms before they become available. Nobody will be charged without their explicit consent.
Your health and training safely
Gymie helps you plan and log workouts and meals, but it is not medical or dietary advice. The voice coach's tips, the plans, and the calculation of your goal, calorie and macro targets are general and do not take any individual's health into account.
See a doctor before you start training, train harder or change your diet, especially if you have a chronic condition or an injury, are pregnant, have an eating disorder or take medication.
Train within your limits, with proper technique and a spotter where needed. Stop if you feel pain, dizziness, shortness of breath or any other worrying symptom, and in an emergency call 112.
Steps and calories from Apple Health and Health Connect come from other apps and devices and may be inaccurate.
AI meal analysis
The analysis is done by an AI model (Claude by Anthropic). The result is an estimate, not a measurement: the model can mistake the food, the portion size, ingredients hidden from the camera or how the meal was prepared, so the calories and macros can differ significantly from the real ones.
Check the result and correct it when it is off. Do not base health-critical decisions on it, such as insulin dosing, a diet for a food allergy or a therapeutic diet.
Only send photos and descriptions of meals for analysis, without other people or their data. How we process the data is described in our Privacy policy.
Friends and your content
The content you send to friends (voice recordings, photos, captions and the like), your profile photo and the data you save in Gymie remain yours, and you are responsible for them. You give us a non-exclusive, free licence to store, copy and transmit that content only as far as needed to provide the services, for example to deliver a message to a friend. The licence ends when the content is deleted.
Content you send to friends must not:
- be unlawful, in particular incite violence or hatred, contain threats or depict the abuse of children;
- be offensive, harassing, intimidating or abusive towards the recipient or anyone else;
- infringe other people's rights, including copyright, personal rights and image rights: you may only send a photo or recording of another person with their consent;
- contain spam, advertising or malware;
- disclose other people's personal data without a legal basis.
Only the sender and the recipient see a message. You can remove a friend at any time.
Profile photo
A profile photo is voluntary and is user content. It remains yours, and you are responsible for it.
You give us a non-exclusive, free licence to store the photo and show it to other signed-in users of Gymie who have your account's identifier; in practice that is wherever the app shows your account, for example to friends and joint workout partners. The licence covers only what is needed to provide the services, and ends when the photo or the account is deleted.
Your profile photo:
- may only be a photo you have the right to use, including the copyright;
- may show someone else only with their consent, because a person's likeness is protected by law;
- must not be unlawful, offensive or infringe other people's rights.
Any signed-in person who has your account's identifier can see the photo; in practice that is wherever the app shows your account. People who are not signed in do not. You can change or remove it in Profile at any time. You can report a photo that breaks the law or these rules to hubertjaruzal@gmail.com (see the section on reporting content).
What is not allowed
You may not provide unlawful content through Gymie. You also may not:
- use Gymie in a way that breaks the law, accepted standards of conduct or these terms;
- disrupt Gymie, including overloading the servers or getting around limits, security measures or access restrictions;
- access other people's accounts or data;
- scrape data from Gymie automatically, except through a connected AI assistant acting within the scope described here;
- decompile or modify the app, except where mandatory law allows it;
- create accounts for someone else or impersonate anyone.
Reporting content and blocking accounts
You can report unlawful content, or content that breaks these terms, to hubertjaruzal@gmail.com. Please describe the content, say who sent it and when, and explain why it breaks the law or these terms. We handle reports without undue delay.
When we receive credible information that content is unlawful or breaks these terms, we may remove the content, turn off sending messages or block the account. This includes the profile photo: we may remove a photo that breaks the law or these terms, and the app then shows the letter circle again. For serious or repeated breaches we may also terminate the contract (see the section on ending the contract).
We tell the person concerned about the decision and the reasons for it, unless the law forbids it or it would put someone at risk. You can appeal a decision the same way as you make a complaint.
AI assistants
You decide whether to connect Gymie to an AI assistant, and to which one. Connecting requires signing in to Gymie and approving access on a screen that shows what the assistant can and cannot do.
A connected assistant can read part of your account data and add meals and weight, as described in our Privacy policy. It can save at most 200 changes a day. It is worth checking the changes an assistant saves.
The assistant works on its provider's terms (for example Anthropic or OpenAI), under a separate contract between you and that provider. That provider is responsible for the assistant's answers and for what it does with the data the assistant reads.
You can revoke access at any time in the app: Settings, AI assistants, Disconnect. It takes effect immediately.
Rights in Gymie
The app, the websites, the coach's voices and lines, the plans, the graphics and the Gymie mark are protected by law, including copyright, and belong to the provider or its licensors. While you use Gymie, we give you a non-exclusive, non-transferable, free licence to use them for your own non-commercial purposes, in line with these terms.
You may share workout cards and other content Gymie prepares for sharing in other apps, such as social media.
Availability and changes to the service
We aim to keep Gymie running without interruption, but we cannot guarantee it is always available. There may be maintenance breaks, outages, or outages at the providers we rely on. We try to schedule planned breaks when traffic is lowest.
Gymie keeps evolving: we may add, change and withdraw features, change limits and require app updates. We will tell you in advance about a change that significantly and negatively affects your use of the service, and a consumer may then end the contract under the Polish Consumer Rights Act.
We will announce in the app at least 30 days in advance if we stop providing the whole service or a significant part of it.
Test versions of Gymie (beta) may contain bugs and change without notice, and we may end the beta at any time. Signing up for the beta is not a contract to use the app.
Security and risks
Using services over the internet comes with common risks, such as malware, phishing for sign-in details, account takeover, or data being intercepted on an unsecured network. To reduce them:
- only download Gymie from the App Store or Google Play;
- use a strong password that you don't use anywhere else, and never share it;
- only enter your Gymie sign-in details in the app and on getgymie.com and gymie.pl; we never ask for your password in a message;
- keep your system and the app up to date;
- protect your phone with a screen lock, because Gymie data is stored on your phone too.
Connections to Gymie are encrypted. More about our security measures is in our Privacy policy.
Ending the contract and deleting your account
You can end the account contract at any time, without giving a reason and at no cost, by deleting your account in the app (Settings, Account, Delete account) or on the account deletion page. Deletion happens immediately, removes all of your account data from our server and cannot be undone. If you cannot sign in, write to hubertjaruzal@gmail.com from your account's email address and the account will be deleted within 7 days.
A consumer may also withdraw from a contract concluded at a distance within 14 days of concluding it, without giving a reason, by writing to hubertjaruzal@gmail.com or by deleting the account. The services are free, so there is nothing to refund.
You can stop using the app without an account at any time by removing it from your phone. Data stored only on your phone is removed together with the app.
We may terminate the account contract for good reason, such as ending the service or a change in the law that makes providing it impossible, with 30 days' notice. We may terminate it with immediate effect when the account is used for gross or persistent breaches of the law or these terms, in particular to provide unlawful content, after an unsuccessful request to stop, where such a request is possible.
We will delete the account of anyone under 16 once we learn about it.
Complaints
You can make a complaint about Gymie, including about the service not conforming to the contract, by email to hubertjaruzal@gmail.com. Please include your account's email address (if you have an account), a description of the problem, when it happened, and what you are asking for.
We reply by email to the address the complaint came from within 14 days of receiving it. If we need more information to handle the complaint, we will ask for it.
Complaints are free and do not limit your statutory rights.
Liability
We are liable for failing to perform the contract, or performing it improperly, under the general rules. We are not liable, however, for:
- damage resulting from using Gymie in breach of these terms, including ignoring the rules in the section on your health;
- inaccurate data entered by you or coming from other apps and devices;
- content sent by other users, subject to our duties described in the section on reporting content;
- services of other companies that you choose to use, such as AI assistants, app stores or the apps you share content to;
- interruptions and damage caused by force majeure or by people we are not responsible for.
For consumers and those treated as consumers, these rules do not exclude or limit liability where the law does not allow it, in particular for personal injury and damage caused intentionally, nor any rights relating to the service not conforming to the contract.
Towards other users, we are liable only for damage caused intentionally or through gross negligence, and not for lost profits.
Personal data
The provider is the controller of your personal data. How we process it, including health data, is described in our Privacy policy.
Governing law and disputes
The contracts are governed by Polish law. This choice of law does not deprive a consumer of the protection given by the mandatory rules of the country where the consumer habitually resides.
Disputes are settled by the common courts. Disputes with users who are neither consumers nor treated as consumers are settled by the court competent for the provider's registered place of business.
A consumer may use out-of-court ways of handling complaints and claims, for example free help from a municipal or district consumer ombudsman (rzecznik konsumentów) or consumer organisations, a permanent consumer arbitration court at a regional Trade Inspection office, or mediation. Information and addresses are at polubowne.uokik.gov.pl. The provider's participation in such proceedings is voluntary.
The EU online dispute resolution (ODR) platform was closed on 20 July 2025, so we do not link to it.
Changes to these terms
We may change these terms for good reason: a change in the law or a decision of an authority, a change in the scope or way the services are provided, new features, security, or preventing abuse.
We announce a change in the app and on this page at least 14 days before it takes effect. We use a shorter period only when the law requires it or when the change counters abuse or a security threat. Changes never apply retroactively.
If you do not agree with a change, you can delete your account at any time, including before the change takes effect, and so end the contract at no cost. Using your account after a change takes effect means you accept it.
